Welcome to HeadshotCraft. These Terms of Service ("Terms") govern your use of the AI headshot generation service operated by Nextfield Labs LLC ("Company," "we," "us," or "our"), a Wyoming limited liability company.

By accessing or using HeadshotCraft at headshotcraft.com (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 16 years old to use the Service.
• If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

• You may create an account using Google OAuth or email.
• You are responsible for maintaining the security of your account.
• You are responsible for all activity under your account.
• Notify us immediately at contact@headshotcraft.com if you suspect unauthorized access.

3. Description of Service

HeadshotCraft is an AI-powered tool that generates professional headshot photographs from a selfie you upload. You upload a photo, select a style, and our AI generates multiple professional headshots.

3.1 Service Plans

We reserve the right to modify plans and pricing with 30 days' notice to existing subscribers.

4. Your Photographs

4.1 Ownership

• You retain all rights to photos you upload.
• By uploading a photo, you grant us a limited, non-exclusive, temporary license to process your photo solely to provide the Service.
• This license terminates when your photo is deleted (automatically after 48 hours, or when you request early deletion).

4.2 Consent

• By uploading a photo, you represent that:
  • You are the person in the photo, OR you have explicit consent from the person in the photo to use the Service.
  • You will not upload photos of minors under 16.
  • You will not upload photos of any person without their knowledge and consent.

4.3 Photo Deletion

• All uploaded photos and generated headshots are automatically deleted 48 hours after upload.
• You may request immediate deletion at any time via your account dashboard or by emailing contact@headshotcraft.com.

5. Generated Headshots — Ownership & Use

5.1 Ownership

• You own the generated headshots created from your uploaded photos.
• We do not claim any ownership or license to your generated headshots after you download them.

5.2 Commercial Use

• You may use generated headshots for personal and commercial purposes, including but not limited to: LinkedIn profiles, resumes, company websites, business cards, marketing materials, and social media.

5.3 AI-Generated Content Disclaimer

• Generated headshots are AI-created and may not perfectly represent your appearance.
• We do not guarantee that generated headshots will:
  • Be an exact likeness of you.
  • Be free from visual artifacts or imperfections.
  • Be suitable for any specific purpose (e.g., official identification documents).
  • Not inadvertently resemble other individuals.
• You are solely responsible for reviewing generated headshots before use and ensuring they are appropriate for your intended purpose.
• Do NOT use generated headshots as official identification photos (passports, government IDs, driver's licenses) unless the relevant authority explicitly permits AI-generated photos.

6. Acceptable Use

You agree not to use the Service to:

• Upload photos of other people without their consent.
• Upload photos of minors under 16.
• Generate headshots for fraudulent purposes (fake identities, catfishing, impersonation).
• Generate content that is obscene, harassing, defamatory, or promotes violence or hate.
• Generate child sexual abuse material (CSAM) — zero tolerance, immediate account termination and law enforcement report.
• Attempt to reverse-engineer, decompile, or extract the AI models.
• Use automated scripts or bots to access the Service beyond any provided API.
• Circumvent usage limits or access controls.
• Resell access to the Service without written permission.
• Violate any applicable laws or regulations.

We reserve the right to suspend or terminate accounts that violate these terms without refund.

7. Payment Terms

7.1 Billing

• Payments are processed by Stripe.
• One-time purchases (Basic, Pro) are charged at the time of purchase.
• Team plans are billed per person.
• All prices are in USD.

7.2 Refunds

• See our Refund Policy for full details.
• Summary: Full refund within 7 days if unsatisfied, provided fewer than 10 headshots have been downloaded.

7.3 Taxes

• Prices do not include applicable taxes. You are responsible for any taxes imposed on your purchase, except for taxes based on our income.

8. DMCA & Copyright

We respect intellectual property rights. If you believe content on our Service infringes your copyright:

Your notice must include:

1. Identification of the copyrighted work.
2. Identification of the infringing material with information to locate it.
3. Your contact information.
4. A good faith belief statement.
5. A statement under penalty of perjury that the notice is accurate.

We will respond to valid DMCA notices within 10 business days.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We disclaim all warranties, express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose.
• That the Service will be uninterrupted, error-free, or secure.
• That AI-generated headshots will accurately represent your appearance.
• That generated headshots will be suitable for official identification purposes.
• That generated headshots will not inadvertently resemble third parties.

AI-generated images are approximations. They are created by machine learning models and may contain artifacts, inaccuracies, or unexpected results. You acknowledge this inherent limitation of AI technology.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, reputation, or business opportunities.
• We are not liable for any consequences arising from your use of generated headshots, including but not limited to rejection of headshots by third parties, misidentification, or reputational harm.

11. Indemnification

You agree to indemnify and hold harmless Nextfield Labs LLC, its officers, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Photos you upload (including uploading photos without proper consent).
• Your use of generated headshots.
• Your violation of any third-party rights.

12. Termination

• By You: Delete your account at any time from account settings.
• By Us: We may suspend or terminate your account for violation of these Terms.
• Upon termination, your right to use the Service ceases. Sections 5.3, 9, 10, 11, and 13 survive termination.
• All photos are deleted within 48 hours of upload regardless of account status.

13. Governing Law & Disputes

• These Terms are governed by the laws of the State of Wyoming, USA.
• Disputes shall be resolved through binding arbitration (AAA Commercial Arbitration Rules).
• Class Action Waiver: You agree to resolve disputes individually.
• Small claims court actions (under $10,000) may be brought in any court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or on-site notice with at least 30 days' notice for existing paid users. Continued use constitutes acceptance.

15. Miscellaneous

• Severability: If any provision is unenforceable, the remaining provisions remain in effect.
• Entire Agreement: These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement.
• No Waiver: Failure to enforce any provision does not constitute a waiver.
• Assignment: We may assign these Terms. You may not assign without our consent.
